Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and Kirbo Labs, Inc. ("Kirbo," "we," "us") governing your use of the Kirbo Guardian and Kirbo Kids apps and related services (the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
Who can use Kirbo
You must be at least 18 years old and the parent or legal guardian of any child whose profile you create. By using the Service you represent that you have the authority to consent, on your child's behalf, to the collection and use of their information as described in our Privacy Policy. The Kirbo Kids experience is intended only for children whose parent or guardian has set it up and provided consent.
What Kirbo is
Kirbo is a safe AI companion for children ages 4–16. It is made up of two connected apps: Kirbo Guardian, where you set your Family Value Pillars, manage child profiles, and receive safety alerts and reports; and Kirbo Kids, where your child chats with Kirbo for stories, learning help, and conversation. Every conversation is available to you, and Kirbo monitors conversations for safety concerns.
Parental responsibility and supervision
You are responsible for setting up profiles, configuring your family rules, and supervising your child's use of Kirbo. The Family Value Pillars and safety settings you choose shape how Kirbo responds. While Kirbo is designed to be safe and to alert you to serious issues, it is a tool to support your parenting — not a replacement for your supervision, judgment, or care.
Accounts and security
You are responsible for keeping your account credentials, child login PINs, and parent-mode PIN confidential, and for all activity under your account. A single family account may support two linked parent/guardian accounts, both with full access. Notify us promptly at hi@kirbokids.com if you believe your account has been compromised.
Acceptable use
You agree not to misuse the Service, including by: using it for anyone other than your own children; attempting to access another family's data; reverse-engineering, scraping, or interfering with the Service; using it to harm or harass others; or using it in violation of any law. We may suspend or terminate accounts that violate these Terms.
AI, safety, and important limitations
Kirbo uses artificial intelligence. AI can make mistakes, may occasionally produce inaccurate or unexpected responses, and is not a substitute for professional advice (medical, mental-health, legal, or otherwise). Our safety monitoring covers 30+ categories and is designed to alert you quickly to serious concerns, but it is provided on a best-effort basis and cannot detect or prevent every risk. You should not rely on Kirbo as your only means of keeping your child safe. Kirbo's educational help uses a Socratic approach and is meant to support, not replace, schoolwork and teachers.
Wellbeing features
Kirbo includes features intended to encourage healthy habits — for example, after roughly 30 minutes of continuous use, Kirbo may gently suggest that your child take a break and move around. These suggestions are for general wellbeing only and are not medical advice or a guarantee of any health outcome.
Beta, plans, and payments
Kirbo is currently offered as a free beta to families in the United States and Mexico. Beta features may change, and the Service may be unavailable or interrupted at times. Paid plans will be announced before we exit beta; families who join during beta receive a permanent founding-family discount as described at sign-up. If and when paid plans launch, applicable pricing, billing, and cancellation terms will be presented before you are charged.
Your content and license
You and your child retain ownership of the content you provide (such as messages and profile details). You grant us a limited license to host, process, and use that content solely to provide and improve the Service as described in our Privacy Policy — including generating responses, monitoring for safety, and creating your reports. We do not claim ownership of your family's conversations and do not sell them.
Intellectual property
The Service, including the Kirbo name, logo, software, and content we provide, is owned by Kirbo Labs, Inc. and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your family's personal, non-commercial use, subject to these Terms.
Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we handle your family's information and your rights, including COPPA, Canadian, and Mexican requirements. Please review it carefully.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will detect every safety concern.
Limitation of liability
To the maximum extent permitted by law, Kirbo Labs, Inc. and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or goodwill, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for gross negligence or willful misconduct, or rights you have as a consumer.
Indemnification
You agree to indemnify and hold harmless Kirbo Labs, Inc. from claims arising out of your misuse of the Service or your violation of these Terms or applicable law.
Termination and data deletion
You may stop using the Service and delete your account at any time from the Guardian app, which permanently deletes your family's data as described in our Privacy Policy. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive termination (such as disclaimers and limitations of liability) will survive.
Governing law and disputes
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules, except where the mandatory consumer-protection laws of your country of residence (including the United States, Canada, or Mexico) provide you with additional rights that cannot be waived. Kirbo Labs, Inc. is based in Calgary, Alberta, Canada. We encourage you to contact us first to resolve any dispute informally.
Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Continued use of the Service after changes take effect means you accept the updated Terms.
